Terms and Condition
Please read the following Terms and Conditions before participating in the Phase II Auditions (hereinafter referred to as “Auditions”) conducted by Asianet Star Communications Private Limited (“Company”) and/or the Production House (defined below). By voluntarily participating, You agree to be bound by these Terms and Conditions and represent that you satisfy all of the eligibility requirements set out herein below.
The following terms and conditions (“Terms and Conditions”) govern the entire process for Auditions (as defined below) as detailed herein for participation in the non-fiction knowledge based reality program tentatively titled “FASTEST FAMILY FIRST-Adi Mone Buzzer (“Program”) and shall be binding on each participant (“Participant”, “Contestant”, “Your “and/or “You”) residing in the State of Kerala and is a citizen of India (hereinafter referred to as “Territory”) who voluntarily participate in the Auditions hosted by the Company and/or Production House (as defined below) for the purpose of selection and participation of Participants in the Program to be aired on, inter alia, on the Company’s and/or its network of channels and/or any other channel as deemed fit by the Company (hereinafter collectively referred to as “Channel”).
The Privacy Policy, Terms of Use and User Generated Content are incorporated herein by reference and are simultaneously available at https://www.startv.com/legal-terms-policies/terms/contest-terms-conditions/Fastest-Family-First/. By proceeding further, You and/or Your Parent (as defined below) on Your behalf are representing to the Company and/or Production House that Your participation in the Auditions is in compliance with all laws applicable on You and You are not in any manner prohibited from participating herein by any law.
These Terms and Conditions shall be irrevocably binding on each Participant and Parents for and on behalf of the Minor Participant (as defined below), voluntarily participating in the Auditions. Company will have access to and collect information and data shared by the Participants / Parent of the Participant (in the case of Minor Participant) including their personal information for the purposes of the Auditions and/or Program. By participating in the Auditions, the Participant / Parent on behalf of the Minor Participant hereby consents to the collection, storage, disclosure, processing, transfer, sharing and deletion of the Personal Information (as defined below) by the Company, its affiliates, and designated third parties in accordance with the terms of its Privacy Policy which is accessible at http://www.startv.com/legal-terms-policies/#wpp and the Personal Data Privacy Policy available at http://www.startv.com/legal-terms-policies/#pdpp (collectively the “Privacy Policy”).
By participating in the Auditions, it is deemed that the Participant / Parent on behalf of the Minor Participant has read, understood, accepted and agreed to unconditionally abide with all the Terms and Conditions and Privacy Policy. The Participant’s act of voluntarily participating in the Auditions in the manner as detailed below shall be deemed to be the Participant’s and/or the Parent’s on behalf of the of the Minor Participant(s) absolute acceptance to the Terms and Conditions, Terms of Use, Privacy Policy and User Generated Content of the Company as prescribed from time to time (hereinafter collectively referred to as “Terms and Conditions”). If the Participant / Parent on behalf of the Minor Participant does not agree to be bound or cannot comply with any of the Terms and Conditions, please do not continue. Failure to accept these Terms and Conditions or the Privacy Policy or Terms of Use or User Generated Content will disqualify the Participant’s participation in the Auditions. The Auditions shall be governed by the Terms and Conditions stated herein below and all participants / Parents on behalf the Minor Participant(s) are requested herein unconditionally accept and agree to comply with and abide by the same.
You or Your Parent on your behalf (if you are a minor Participant) are required to sign on all pages of this Terms and Conditions. The failure to accept these Terms and Conditions by You or Your Parent (as the case may be) will disqualify your participation in the Auditions.
A. DEFINITIONS
1. Call For Entry (CFE)” means the registration process for participating in the Auditions and /or Program as per the terms stated herein, wherein all interested Registrants are invited to register as per the manner set out below in case, they are interested in appearing and participating in the Auditions and /or Program.
2. “Tele Auditions” means different levels comprising of Level 1 of the selection process of the Auditions as detailed herein, to be conducted inter alia in the manner as set out herein during the Tele Auditions Period which the Participant(s) is required to register for the Auditions, qualify for the further Levels and be shortlisted for participating in the Program as per the terms stated herein.
3. “On Ground Audition(s)” shall mean different levels comprising of Level 2 and/or Level 3 of selection process of Auditions as detailed hereunder and any additional levels as may be incorporated thereinafter by the Company at any point of time at its discretion, to be conducted inter alia at the Audition Center(s), which the Participant(s) is required to qualify and pass for participating in the Program.
4. “Audition(s)” shall mean jointly and/or severally the Tele Auditions and/or On Ground Auditions and different Levels of selection process to be conducted inter alia in the mode and manner as detailed hereunder during the Audition Period (defined below), which the Participant(s) is required to qualify to participate in further Levels for participating in the Program.
5. “Audiotionee(s)” collectively means Registrant(s) along with his / her respective Partner(s) (defined below) as may be applicable for different Category(ies) (defined below) who are shortlisted and selected as a pair for participation in the On-Ground Auditions, i.e. Level 1 and Level 2 basis the parameters set out herein.
6. “Call For Entry (CFE) Period” shall mean the period commencing from July 13, 2022 and continues till July 18, 2022 during which promotions will be aired inviting all viewers to register for the Audition, or such other date stipulated and/or updated by the Company and/or Production House at its sole discretion on the website https://www.startv.com/legal-terms-policies/terms/contest-terms-conditions/Fastest-Family-First/ (“Website”/ “Platform”) and required to be checked by You or the Parent on behalf of the minor Participant(s) from time to time. The period can be extended or reduced by the Company and/or Production House at its sole discretion from time to time.
7. “On Ground Audition(s) Date(s)” shall, mean on such dates fixed and communicated to the shortlisted Participants by the Company and/or Production House.
8. “Audition Centre(s)” shall mean the cities of Calicut, Cochin and Thiruvananthapuram or any other locations in the State of Kerala where the Shortlisted Participant(s) need to make themselves available for further levels of auditions as per the selection procedure.
9. “Audition Period” in respect of CFE shall mean the period as mentioned hereinabove and for On Ground Auditions shall mean the period as fixed & announced by the Company and/or Production House from time to time at its discretion through the website and/or through any other medium from time to time required to be checked by You or the Parent on behalf of the minor Participant(s) from time to time.
10. “Contestant(s)/ Participant” means and includes all Registrant(s), Auditionee(s), Participant(s) who register and participate in the Auditions and /or Program along with his / her respective Partners as per the terms stated herein, all collectively referred to as “Contestant/ Participant(s)”. For avoidance of doubt it is clarified that for the purpose of registering and /or participating in the Auditions and qualifying further for participation in the Program, it is mandatory that the interested Registrant and /or Auditionee shall have the required eligibility criteria applicable for the Category for which he/she is registering and that such interested Registrant and /or Auditionee participates in the On Ground Auditions and /or the Program along with his / her respective Partner(s) as may be applicable for such Category only.
11. “Minor Participant(s)” / “Minor Contestant(s)” means any natural person(s) who is (i) below 18 (Eighteen) years as of date of Registration, being an Indian citizen and resident of State of Kerala and who participates in the Auditions /Program along with his / her Partner in accordance with the terms detailed below.
12. “Excluded Registrant(s)” means and includes, employees of the Company or any Group Company, employees of the Producer, employees of the advertising agencies which has been appointed by the Company, employees of the call centre engaged for this Competition, employees of the back end IT service provider, employees of Auditors, participants who does not fulfill the eligibility criteria of becoming a Registrant’s and also employees of the main sponsors and members of their immediate family. Further, all those not conversant in Malayalam and cannot read either English or Malayalam are ineligible to enter the Competition. For clarification the Registrant(s) should be conversant in Malayalam and should be able to read and understand either English or Malayalam.
13. “Parent” means (i) father or mother of the Minor Participant, participating in the Auditions /Program.
14. “Exploitation/Exploit” shall mean the exploitation of the Works including along with its cognate forms and grammatical variations, means and includes the exploitation, use, alteration, broadcast, rebroadcast, communication, encryption, transmission, translation, adaptation, publication, cutting, editing, and packaging of the Intellectual Property vested in the Works, either in whole or in part, in any form/format or language, as may be decided by the Company in its sole discretion and shall include incorporation of the Works including performances in the Program or any audio visual recording or sound recording or as may be decided by the Company in its sole discretion as well as the conversion of the Works from one form/format to another and in relation to the Works, making of a Cinematograph Film or Sound Recording, Communication to the Public, Broadcast, Performance in Public, adaptation, reprography, reproduction, distribution, sale, commercial rental, assignment, licensing, merchandising rights, remakes, sequels, prequels, versions, translations, dubbing and/or subtitling in any all languages/dialects in the world, converting the Works for theatrical exploitation, including but not limited to the broadcasting thereof by any form of radio, internet and any and all form of television including but not limited to terrestrial, satellite, direct to home, cable, IPTV, any form of video on demand (including but not limited to Pay-per-View, NVOD, SVOD, PVOD, FVOD, AVOD made available for being seen or heard or delivered or exploited through wire or wireless including but not limited to internet, websites including but not limited to social networking websites, blogs, internet or mobile streaming or download services (whether free, pay or subscription based) computing and networking devices, mobile/telecommunication system based platforms, mobile TV, theatrical or non-theatrical or any other means whether now known or existing or in commercial use or hereinafter invented or developed in the future in and to the Intellectual Property and all elements thereof. The capitalized terms ‘Broadcast’, ‘Communication to the Public’, ‘Cinematograph Film’, ‘Performance /Perform in Public’, ‘Sound Recording’, ‘Visual Recording’ shall have the same meanings as defined in the Indian Copyright Act, 1957 as amended from time to time and all analogous rights subsisting under the laws of each and every jurisdiction throughout the world.
15. “Intellectual Property” means and includes all performances, performers’ rights, publicity rights, brands, rights if any vested in the Participant relating to or in the footage owned by the Company, concepts, confidential information, copyrights, databases, designs, formulae, franchises, goodwill, know-how, licenses, ‘look and feel’, music (including songs, sheet music, lyrics and remixes), permits, proprietary information and knowledge, scripts (and their sound recordings), segments, set designs, service marks, technology, titles, trademarks, trade names, trade secrets, format rights, and all other allied, ancillary and subsidiary rights in any and all media whether now known or subsequently invented, as well as all other intellectual property as is commonly understood and recognized as such by applicable law, (past, current or future) industry usage, or otherwise.
16. “Level(s)” shall mean collectively Level 1, Level 2 and Level 3. The term “Level(s)” shall be construed accordingly to refer to anyone (1) particular level of the Auditions as signified by the corresponding number.
17. “Partner(s)” shall mean the natural person(s) who are participating along with the Registrant(s) in the Auditions and/or the Program and meeting the eligibility criteria as may be applicable for the respective Category(ies) in which they are participating.
18. “Production House” / “Producer” means Reliance Entertainment Studios Private Limited, engaged by the Company for the production of the Program.
19. “Registrant(s)” means any natural person(s) who participates in the Auditions and /or Program and who (i) fulfils the eligibility criteria prescribed for the Category in which they are registering (ii)is a Parent to a child who falling within the parameters of a Minor Contestant defined herein ,(iii)is a citizen of India residing in the State of Kerala (iv) is of sound mind and health (iv) has not participated in any of the previous seasons of Program based on the format “FASTEST FAMILY FIRST” in any of the Indian language and (v) enters the Auditions in accordance with the Terms and Conditions as stated herein. For avoidance of doubt, it is clarified that for the purpose of registering and /or participating in the Auditions and qualifying further for participation in the Program, it is mandatory that the interested Registrant is a Parent to a child who falling within the parameters of a Minor Contestant and that such interested Registrant participates in the On Ground Auditions and /or the Program along with his / her such Minor Participant only.
20. “Randomizer” is a software that generates random bits of information from a given set of data as per predetermined parameters.
21. “Category(ies)” shall mean the category in which the Registrant(s) can participate subject to their eligibility criteria as may be applicable for each category as listed below:

22. "Show(s)" means each episode(s) of the Program including any Special Show(s).
23. “Show Player(s)” means the final 150 (one hundred and fifty) pairs of selected Contestant(s) along with 50 (fifty) pairs of standby Contestant(s) who are selected through the process of the Audition(s) as enumerated below to participate in the Program. Provided however that the Company and/or the Production House shall have the absolute discretion to increase / decrease the number of Show Players depending upon their programming requirements and without any further notice to the Contestants and/or the Viewers.
24. “Special Show(s)” means any episode/s of the Show recorded with Contestant(s) who belong to a category other than that specified hereunder, which may include celebrities or children special, or any other category which may be decided upon by the Company in its sole discretion. Such episodes may have additional rules (as amendments/attachments) to which the Contestants will have to comply with along with all the other rules of the Competition.
25. “Studio" means any venue/ location as deemed fit by the Company and/or Production House for filming of the Program.
26. “Winner(s)” means the Show Players, team of Show Players who correctly answers the question posed by the Host of the show.
27. “Works/Materials” shall mean and include Footage (as defined below), Entries, On Ground Entries, footage of Promotional material including any form of artistic works, works of authorship, performances and services made by the Participant(s) or compilation, data which is developed, created, discovered, invented or otherwise brought into existence by the Participants during the course of Auditions/Program/Show or the Auditions and any other Intellectual Property created/ generated by the Participants during the course of participation in the Auditions/Program/Show.
B. PRINCIPAL RULES
1. The Company shall promote the Call For Entry process of the Auditions, i.e. level 1 of the Auditions (“CFE”) through on-air (promos, astons, bugs etc.), print, radio, online, official social media pages/handles of the Company or any other manner as the Company may deem fit, at its sole discretion, stating the mechanism in which the Contestant(s) can participate in the CFE, Auditions, wherein the Contestant(s) can get details of the Auditions, timings, venue(s) of Auditions Centre etc
2. Procedure to Register
2.1 During the CFE Period, on a daily basis, commencing at 18:00:00 and ending at 17:30:00 (IST) the next day, 1 (one) question having multi choice answers will be triggered on the Channel daily during the CFE Period [“Question(s)”]. The Question shall remain same throughout the day and will be refreshed daily. The total number of Questions triggered during the Period shall not exceed five (5) in number.

3. Participation Mechanism
3.1 SMS
3.1.1 To participate and register for the Auditions and to qualify for Level 1, the Registrant(s) has/have to give the correct answer to each of the Question(s) by sending the entry/ answer in the manner prescribed herein below:
3.1.2 Registrants shall be required to correctly answer each Question(s), by sending SMS (of the correct answer from options A, B, C and D) during the Period in the following format to 5757520:
3.1.3 It is clarified that each Question shall have only 1 (one) correct answer and to qualify and participate further in the Auditions , the Registrant shall be required to provide the correct answer to ANY Question(s) on a daily basis within the predefined timelines as set above by sending an SMS containing the keywords FFF <space> Correct Option (A/B/C/D) <space> pin code > (“Answer”)

NOTES: For PINCODE, Registrant has to enter the PIN CODE for which he/ she has to furnish supporting documents as and when called for by the Production House / Company.
3.1.4 Answer(s) received after CFE Period will not be considered and shall be deemed null and void without requirement of any further intimation. For purposes of this Contest, “receipt” of Answer(s) occurs when the mobile/network operator records the Answer information upon the Registrant (s) sending the SMS and the Registrant (s) receiving a thank you message VIA text message or SMS saying “Congratulations. Your entry has been registered. Please visit at http://www.startv.com/legal-terms-policies/#contest-tandc for more details. Please refer to terms and conditions”. For avoidance of doubt it is further clarified that the exact contents of such text message or any brand association for the same and /or the right to decide if to send such text message shall vest with Company only and the Contestants shall not in any manner be entitled to dispute such decision by the Company.
3.1.5 If there is an error in the SMS format sent by the Registrant, then the error message will read as “Your entry has not been registered. Please submit the entry in the following manner, the correct format is FFF followed by <space> followed by their options <A/B/C/D> for the Question <space> followed by <space> pin code”
3.1.6 If the Registrant (s) provides an incorrect Answer(s) to the Question(s), then his/her Entry for such Question(s) shall be considered incomplete, and the Registrant (s) shall not be eligible to proceed further.
i. For the purposes of this Auditions, Registrant(s) who are subscribers of Airtel, Vodafone Idea, Tata, JIO, BSNL shall be able to participate further in the Auditions via SMS.
It is clarified that all costs incurred by the Registrant(s) to participate and register including but not limited to sending SMS shall be solely borne by the Registrant(s) without any recourse to the Company. The cost charged to the Registrant(s) by the respective network provider(s) shall be @ Rs.3/- (Rupees Three only) per message. For better clarity, it is explained that Registrants who are using a prepaid mobile connection should have a minimum of Rs.3/- in their account balance to send the message. Also, all SMS will be charged by the operators irrespective of whether the message has been sent in the correct or incorrect format.
**Rates are subject to change due to recent TRAI regulations. Registrants are requested to check rates with their telecom operators.
Registrants are further requested to check with their telecom operator for applicable circles any other applicable charges. In case any registrant desires to register while roaming in a different circle/zone/country, additional Roaming rates may apply. Hence registrants are requested to contact their telecom operator for the applicable rates.
It is clarified that the above-mentioned charges will be applicable to all valid & invalid Entries sent through the participation mechanism.
Each Registrant may submit multiple entries. Valid entries sent each day shall only be considered for the random selection process for that day. It is to be noted that multiple entries does not guarantee selection and no weightage is given to number of SMSs sent at the time of shortlisting. Registrant is advised to apply his/her discretion while making such multiple entries in view of cost of SMS.
ii. Providing the correct Answer(s) for the Question(s) during the Period by the Registrant (s) through SMS in the mode and manner prescribed herein shall be considered as a complete and valid entry (“Entry”). For the avoidance of doubt, by submitting the Entry and /or Answer(s) the Registrant (s) is acknowledging and representing that the Entry(s) and /or Answer or contents thereof are not confidential or comprise.
iii. It is further clarified that for the purposes of the Auditions and to be eligible For FURTHER LEVELS, it is mandatory that the mobile/ landline number through which the Registrant participates in the Auditions via SMS is duly registered in his /her name.
iv. If the Registrant submits an Answer multiple times on a day from the same mobile number, then the Answer submitted by him/her shall be considered for one entry for the purpose of the Auditions and the remaining entries will be rejected and deemed null and void.
v. It is further clarified that if a Participant(s) has already been shortlisted once for level 1 though SMS, then he/she shall not be eligible to be shortlisted again.
4. The selection and shortlisting process for the Auditions shall be conducted as detailed below for each Level of the Auditions. For the sake of clarity, a Registrant/ Participant cannot enter the Auditions without undergoing the process at each Level:

4.1 During the Period, based on the Registrant (s) having made a valid Entry, providing correct Answers to the Question (s) daily as stated herein, Company shall by way of random selection vide a Randomizer, select and finalize at its discretion a maximum number of 14000 Registrants to qualify and participate in Level 1. For avoidance of doubt, it is clarified that the Company shall be free and entitled to increase or decrease the number of such shortlisted Registrants at its sole discretion. These Registrants shortlisted for Level 1 shall be selected and declared based on (i) the aforementioned criterion and (ii) pre – defined reservation parameter as defined and detailed below by the Company at its sole discretion. It is clarified that the below mentioned reservation parameter is unconditionally binding on all Contestants and the Contestants cannot challenge the same. It is further clarified that at a point of time during the Period, the Company has the sole and exclusive right to at its discretion amend or modify or put in abeyance below mentioned pre – defined reservation parameter or introduce any new parameter or criteria for shortlisting Registrants in any manner as may be deemed fit by the Company without any further intimations to the Registrants and the Registrants shall be unconditionally bound by such decisions of the Company.

4.2 In the event one or more cells of the grid are not capable of being completed by the randomizer software due to inadequate valid Entries, the balance Entries may be filled at the sole discretion of the Company basis any parameters or criteria as deemed fit by the Company. It is clarified that shortages in the grid on any one day could either be made up from other correct registrations of that day, or in subsequent days during the Period. This is applicable only for this level. Timelines are subject to change based on on-ground conditions, degree of participation, technical issues, force majeure reasons, etc.
4.3 The Registrants shortlisted via the Randomiser vide the grid mentioned above will receive calls from the call center executives (“CCE”) during the period commencing from July 15, 2022, to July 31, 2022. All calls during this aforementioned period shall be made by the CCE between 9:00 am and 9:00 pm. Selected Registrants must confirm all the details as may be required by the call center executives (“CCE”) immediately. The CCE will ask the Registrant to confirm if he/she has sent the Entry for participation in the Auditions and the Category in which he /she has registered. The CCE also ask the Registrant to provide the PIN Code of the Area of the Registrant. If the required details are not provided immediately or if they are not able to procure confirmation of the Registrant, shall lead to disqualification of such Registrant from the further levels of the Audition and /or Program.
4.4 The Company shall not be liable in the event the Registrant is not able to participate in the following rounds of selection due to any delay or non-receipt of such call back to the Registrant.
4.5 The first person who answers the registered phone number and claims/confirms that he/she is the Registrant, unless expressly stated otherwise, will be considered as the Registrant. Company will not be responsible to determine the correct Registrant in the event more than one person has participated from a particular number. In case the Registrant has participated in the earlier season of the Program or appeared OR participated in any of the seasons in any of the Indian language of the format “FASTEST FAMILY FIRST”, he/ she will be disqualified for further selection and in case of dispute being raised by registrants in this regard, decision of Company shall be final. Company shall also be entitled to disqualify all entries from the concerned number which is the subject matter of dispute.
4.6 Further Company is not responsible if the call-back is not successful due to including but not limited to the following reasons:
a) Line being busy/dead/ out of service
b) Congestion on the network
c) No answer received
d) Number does not exist
e) Number has been disconnected
f) Out of coverage area
g) Switched off
h) Poor call conditions / unclear reception

k) Other reasons that could render a call unsuccessful or terminate it.
4.7 Company and/or its authorized agents, affiliates and representatives will use their reasonable efforts to contact the selected Registrants but will not be responsible or liable in any way whatsoever if the Registrants cannot be reached by telephone within the next thirty minutes after initial contact is made.
4.8 The following process will be followed by the CCE once connected with the selected Registrants:
i. If the receiver of the call confirms immediately to the CCE that he/she is the Registrant, then the CCEs will ask the Registrant to provide his/her Name and city of residence. The CCEs will check the Category in which he/she is registering and also confirm his/her availability for the Audition Period. In the event the Registrant is available during the Audition Period as per the dates mentioned therein, the CCE will capture the address and other details required to continue with the registration. In the event the Registrant is not available on those dates, the Registrant will not be permitted to continue with the registration process and shall be considered as disqualified from further participation.
ii. The CCE will thereafter ask the Registrant to give answer to two “skill based” questions asked one after another, and give one answer to “nearest to answer” question** (i.e. the answer provided by the Registrant must be closest to the correct answer). For avoidance of doubt, it is clarified that for the purposes of proceeding further and qualifying for the next level, providing correct answers to the 2 (two) skill-based questions and the nearest answer to the “nearest to answer” question shall be considered as a complete and valid entry (“Entry”). If the Registrant (s) provides an incorrect answer(s) to any of the skill-based or “nearest to answer” question, then his/her Entry shall be considered incomplete, and the Registrant(s) shall not be eligible for proceeding for the further level.
iii. Upon the Registrant answering the above-mentioned questions as per the above-mentioned criteria, the Registrant if selected will receive a call within the next few days for further participation level 3.
*For all questions the Registrant is required to provide answer within 10 seconds
**The “nearest to answer” question is an open-ended question (e.g. what is the distance in km between Bangalore and Mumbai) for which the Registrant is required to provide his/her answer.
It is clarified that Entries from the same mobile /telephone number will be considered by the randomizer software only once for the purposes of this level in the manner as mentioned herein
5. PART 2
5.1 On successful completion of Level 1 Part 1, based on the Registrant(s) having provided all personal information as required by the CCE and providing valid Entry(s) in the manner as set out above at level 1 Part 1, Company shall by way of random selection vide a randomizer software, select and finalize at its discretion a maximum number of 7000 Auditionees to qualify and participate in Level 2 and level 3. For avoidance of doubt it is clarified that the Company shall be free and entitled to increase or decrease the number of such shortlisted Registrants at its sole discretion. These Auditionees shortlisted for Level 2 and level 3 shall be selected and declared based on (i) the aforementioned criterion and (ii) pre – defined reservation parameter as defined and detailed below by the Company at its sole discretion. It is clarified that the below mentioned reservation parameter is unconditionally binding on all Contestants and the Contestants cannot challenge the same. It is clarified that in the event that there are less than the required number of Registrants qualifying as Auditionees as per the manner prescribed herein, the Registrants with less than the required number of correct answers, i.e. may be shortlisted and selected by Company shall by way of random selection vide a randomizer as mentioned herein. In the event of a tie, the answer to the “nearest to” questions will be used to select the correct entry. In case of a tie in the “nearest-to” question also, the Company will select the Auditionees on a random basis or any other method as deemed fit by the Company at its discretion. It is further clarified that at any point of time during the Period, the Company has the sole and exclusive right to at its discretion amend or modify or put in abeyance the below mentioned pre – defined reservation parameter or introduce any new parameter or criteria for shortlisting Auditionees in any manner as may be deemed fit by the Company without any further intimations to the Auditionees and the Auditionees shall be unconditionally bound by such decisions of the Company.
5.2 The selection of Registrants to attend the Audition Centers as Auditionees by the randomizer will use the pre-defined reservation criteria on reasonable endeavors basis which is as follows:

5.3 The CCE will notify such selected Auditionee for Auditions by telephone and will confirm their details (age & address) before proceeding further. If the details provided by the selected Auditionee on this call do not match the existing details provided by them, then only one further opportunity will be provided to such selected Auditionee, after which the call will be terminated and the Auditionee will be automatically disqualified from participating further in the Auditions and /or Program.
5.4 The CCE will inform the Auditionee about the Audition Centre and venue and will confirm his /her availability on the Audition Period on the dates and shoot dates as mentioned by CCE. In the event the Auditionee is not available on those dates, the Auditionee will not be permitted to continue with the registration process and will be disqualified from participating and qualifying further.
5.5 In the event the Auditionee is available on the dates as mentioned during the Audition Period, the CCE will ask the Auditionee to carry with them the following documents:
i) 4 recent passport sized colour photographs of the Auditionees (both Registrant and his/her Partner).
ii) For valid identity proof (any one of the following):
a) Aadhar card
b) PAN Card
b) Passport
c) Voter ID or
d) Driver’s License
iii) For Valid address proof (any one of the following):
a) Landline Phone / Electricity Bill
b) Passport
c) Aadhar card
d) Voter ID
e) Driver’s License or
f) Ration card
iv) For Valid age proof of both Registrant and his/her partner (any one of the following):
a) Passport
b) Birth Certificate
v) For proof of relationship between Registrant & his / her partner
a) Passport/AADHAR – for Parent- Kid
b) Birth Certificate – for Parent-Kid.
c) marriage certificate – for Couples Category
d) School ID- for Teacher-Student Category
e) Employee ID- for Colleagues Category
f) Ration Card- for Siblings & Twins Category
The Auditionee with respect to him/her will need to carry the original document and 2 attested photocopies of each document. All the above-mentioned documents must be in Malayalam or English only
It is clarified that the Auditionee(s) failure to submit the aforementioned documents or attend the On ground auditions without the same shall automatically disqualify the Auditionee from further participation in the Auditions and Program.
Note: Travel, accommodation and all other expenses in relation to the participation of the Auditionee in the Audition will be at the Auditionees’ own costs and only the Auditionee will be permitted to enter the Audition venue upon submission of the above-mentioned documents and photographs.
5.6 The CCE will thereafter ask the Auditionee to confirm their availability on the designated Audition Period and Audition Centre and their availability for the given shoot dates. Only upon such confirmation the Auditionee’s participation in the Audition will be considered. The Auditionee will be informed about the Audition Centre, date and time by an automated WhatsApp message on the mobile number used for registration as per the details available with the Company.
5.7 The Company shall not be held liable for telephone system difficulties, downtime of systems, back-up of data, telephone system capacity and other technical impediments during the registration process.
6. LEVEL 2
6.1 The Level 2 of Auditions will be conducted tentatively during the Audition Period. The timings for registration of Auditionees will be intimated and cannot be changed or modified to suit Auditionees’ requirements.
6.2 The Auditionees (both the Registrant and his/her Partner) will have to be present at the allotted Audition venue on the date and time allotted to such respective Auditionees along with the documents and photographs required as hereinabove (both in original and attested photocopy). For avoidance of doubt it is clarified that both the Registrant and his/her Partner should attend the Auditions.
6.3 The doors to the room will be shut at 9:00 AM or at such time as the Company may decide in its sole discretion. Late entrants may stand disqualified from the Audition process at the discretion of Company. Each Auditionee will be provided a unique registration number, which he/she must carry with him/her at all times while at the Audition. The Auditionees will have to sign the registration form along with release form, Non- Disclosure Agreement (NDA) and the Rules and Regulations in order to participate in the Auditions. Company’s authorized representatives will have the final right to refuse registration/eligibility at their sole discretion.
6.4 Subject to completion of formalities as prescribed by Company, the Auditionees (both the Registrant and his/her Partner) will have to go for entrance tests which comprises of two rounds viz. Written Test and Video Audition. The Auditionees shall be jointly and severally required to mandatorily participate, complete both the Written Test and Video Audition, as per the terms stated herein. It is further clarified that if the Auditionees fail to complete both the Written Test and Video Audition or do not fulfil the parameters therein, then he/she shall be disqualified from further participation.
6.5 Written Test for the Auditionees (separate tests will be conducted for Minor Participants)
- The Auditionees will be seated in a hall for the entrance test
- The doors to the room will shut at 9:00 AM or at such time as the Company may decide in its sole discretion. Auditionees arriving later than such time will not be eligible for participation in the Auditions.
- There will be a screen which will display a recording asking ten (10) multiple-choice questions.
- The Auditionees will be given a certain fixed amount of time to fill out their answer options (A / B / C / D), on their answer sheet, before the next question is asked.
- In the event the answer sheet is lost, unreadable, incomplete or untraceable eg, the Auditionee’s name / number is not mentioned on it, such Auditionee may be disqualified.
Video Audition (for both the Registrant and his/her Partner)
- Each of the Auditionees will have to undergo a personal interview about their personal lives with the representatives of the Producer and/or Company.
- The interviews / interactions will be recorded by the Company / Producer for evaluation and for any future use as Footage at the sole discretion of the Company.
- In the event of any unforeseen loss of recordings or if the Video Audition of any particular Auditionee does not meet the satisfaction of the Producer and /or Company, then the Producers at its own discretion shall be entitled to re-record the Video Auditions of such Auditionee at any point of time during the Audition Period and the Auditionee shall be unconditionally bound to remain present for the same.
6.6 All Auditionees shall maintain the decorum at the Audition venue and shall abide by the Rules & Regulations thereof. Further the instructions of the Company / Producers shall be adhered to strictly.
6.7 Any Auditionee who acts in contravention to the instructions of the Company or the Producers or creates nuisance either to the Company or to any other person, shall immediately be disqualified from participating in the Audition and the Competition and shall be asked to leave the Audition venue.
6.8 The decision of the Company/Producers in connection with the Audition including but not limited to short listing the Auditionees will be final & binding and is non-contestable. In case of any dispute or difference in respect of this Audition, the decision of the Company shall be final and binding on all concerned.
6.9 The Company reserves the right to use some of the shortlisted Auditionees as they deem fit for the second (2nd) or any subsequent rounds of Auditions. The dates for the second round (or any subsequent rounds) of Auditions will be subsequently informed to the relevant shortlisted Auditionees.
7. LEVEL 3
7.1 At the end of the Audition Period, a three-member jury i.e. one representative each from Producer and the Company and neutral party will collectively evaluate all the Auditionees who have participated in level 4 on the basis of the maximum number of correct answers submitted by the Auditionees in the answer sheets under the Written Test and the recorded footages of the Video Audition, quality and nature of the personal interview therein of the Auditionees. Shortlisted Auditionees from this evaluation round will be evaluated by the 2nd evaluation jury.
7.2 Basis the first round of evaluation as mentioned above, the 2nd evaluation shall be performed by a three-member jury i.e. one representative each from Producer, the Company and one independent members (“Judges”). It is clarified that the composition of both the juries shall be different. The Judges will finalize and select the Participants from amongst all shortlisted Auditionees evaluated by the first jury as mentioned hereinabove on the basis of the criteria mentioned above or any other parameters or criteria as deemed fit by the Company and /or the Judges. This shall be binding on all Participants and /or Auditionees and neither they nor any one on their behalf shall dispute or challenge these parameters or judgements of the Judges. Out of these shortlisted Participants, approximately 300 (three hundred) number of Participants will be selected for participating in the Program as Show Players.
7.3 Based on Company’s requirement and creative discretion, the final selection of contestants for any Episodes/week of the Show will be made from amongst the shortlisted pool of Auditionees.
7.4 Moreover, there will be special/ celebrity episodes/ weeks for which short-listing of contestants will be performed through an alternate process of registration/casting by Production House/Channel.
7.5 The Company shall not in any way be responsible to or made accountable by any of the candidates selected cannot participate the Program due to selective episodes meant for Celebrity /Special Episodes as may be decided upon by the Company at its discretion.
7.6 The representatives of the Producer (“Representatives”) will notify the selected Auditionees of their selection for the competition round and ask for confirmation of their details (name, gender, date of birth and address), after which the Representatives will inform the selected Auditionees of the shoot date and documentation requirements, based on finalized shooting schedules.
7.7 The Participant is requested to carry a valid English/Malayalam Identity proof and 4 passport size colour photographs of the Participant(s) to the Studio for the shoot. In case of non-availability of Participant or of his/her supporting documentation, further participation will not be permitted.
7.8 The Producer shall be responsible for the travel (shortest route possible upto a maximum of 3rd AC rail fares from the city of their residence to the studio at Kochi and back) and hotel arrangements (boarding/ lodging) and local conveyance of the Participant(s). The travel and stay arrangements will be made as per the Producer’s discretion and any request in this regard by the Participants shall not be entertained. However, in case of Participant(s) residing in Ernakulam District, the Producer shall not be responsible for making any accommodation arrangements. Where the Participant incurs the travel expenses on his own, the producer shall reimburse such travel expenses on actual basis on submission of supporting documents upto a maximum of 3rd AC rail fare for the Participant.
7.9 In the event of the failure of any Contestant to attend the Studio by the time stipulated by the Company or Producer for any reason whatsoever the Company shall be entitled to exclude such Contestant(s) from the Show and the Studio Part of the Competition.
7.10 On the Agreed Show Date Contestants will be met at the Studio by a representative of the Company. Contestants will be required to sign an agreement in standard form for contributors to television programmes and shall include (i) their confirmation that they have understood and agreed to the rules of the Competition, (ii) agree to terms and conditions defined in the agreement and (iii) their consent to the recording of their contribution to the Show in question, and thereafter to the broadcast and all other audio visual exploitation of the same and to the publication of his/her name and photograph in any media.
7.11 The rules and regulations with regard to the Program/prize and/or any other activities will be communicated and explained directly to the Contestants by the Company at the Studio itself, on the day of the recording of the Show.
C. GENERAL RULES
a. General Eligibility Criteria
1. Participation in the Program by sending entries in any of the aforesaid manner shall be considered to be acceptance of these Rules and Regulations.
2. Program is open to citizens of India residing in the State of Kerala and should be of sound health and mind. Persons must enter the Program on their own behalf and entry(ies) by proxy will not be accepted, even for their family members.
3. An entry/ies is not transferrable.
4. Employees of the Company, Producer, advertising agency, auditors, company’s contractors which have been appointed from time to time, and employees of the sponsors; and their respective families; persons other than Indian nationals, or Indian nationals living out of India, or those who do not qualify under the definition of resident of India as per the Income Tax Act, 1961 or those not conversant in spoken Malayalam, are ineligible to enter the Program. Failure to provide proof or affidavit of eligibility, including the proof of name, address and correct date of birth within a reasonable time upon request by the Producer/Company may result in disqualification. The Company also reserves the right to disqualify a Contestant in case a discrepancy is found to exist in the information furnished/provided/stated by the Contestant during the conversation with the Producer/Company or any of the Company’s sub-contractors and vendors in the Program, and/or in the information stated in the documents furnished by the Contestant.
5. The Contestant(s) hereby represents that he/she is not under any exclusive contracts with any other third party/ agency or is not under any kind of disqualification under law to enter into an agreement with the Company or its affiliates, as the case may be.
6. The Contestant(s) shall undertake, warrant and guarantee to the Company that the Contestant has the full legal capacity to participate in the Program in accordance with these Rules & Regulations.
7. By registering for the Program, the Contestant(s) represents that he/she is medically fit and do not have present or past psychological ailments. If in the past he/she has had any psychological ailments or have been under medication for any psychological, anxiety, hypertension, depression or any other medical problems, the same shall be disclosed to the Company/Producer in writing along with a copy of the certificate from a qualified medical practitioner declaring him/her to be fit for participation in the Program.
8. Contestant(s) will not be confirmed as Contestants for the Show if they are suffering from any kind of ill health, medical problems (viz.: heart ailment, blood pressure ailment, final stages of pregnancy, etc.). It is the responsibility of the Contestant(s) to be medically fit for participation. Nevertheless, the final decision regarding their participation in the Studio Part of the Program rests entirely with the Company.
9. The Contestant(s) represent that he/she has not been accused or convicted or is otherwise involved in any criminal offence and/or is not under inquiry or trial by the police or judiciary which has not been disclosed to the Company in writing. That the Contestant(s) is /are not required to be present before any authority including police or any court of law during the shooting dates informed by the Company and has no other disability which would prevent his/her participation in the Audition or the Program (if selected).
10. The Contestant(s) acknowledges that he/she has voluntarily chosen to participate in the Competition at his / her free-will, that the format of the Program, its rounds, terms of play etc has been explained to him / her in detail by the Producer and is willing to bear all risk, costs & consequences arising from such participation in the Competition. It is a condition of entry and participation in the Competition that the Contestant(s) has not entered into any contractual, commercial, sponsorship agreement (including but not limited to recording, performing and/or merchandising contracts) or other arrangement for example with a management company or an individual to act as the Contestant’s manager in respect of his/her musical or performing abilities or the products thereof or in respect of his/her name, likeness, image or biography which might be in breach of the Contestant Release Form or the Rules & Regulations or otherwise prevent the Contestant(s) from participating in the Competition/ Program or the broadcast, promotion, exploitation or sponsorship thereof.
11. Each Contestant is also required to refrain from wearing any clothing items bearing designer or sports logos or bearing the name or likeness of a celebrity, living or dead, during the shoot of the Program. The Contestant(s) are also not permitted to wear or mention any competing TV channel names, or names of competitors of sponsors of the Program. The Contestant shall adhere to the Clothing instructions that shall be provided to him/her in this regard.
12. If Entries are received for participation through the modes as mentioned herein, it is assumed that the person sending in the Entry has provided the Company or their authorized representative with permission to send SMSs to or call him / her, whether or not such sender is registered on the National Do Not Call registry.
b. Information
13. The Contestant is required to furnish necessary supporting documentation as proof of age, address, name, photo identity and nationality i.e. one original and attested photocopies of either (i) passport/driving license or (ii) PAN Card along with birth certificate and ration card or (iii) voter identity card with birth certificate (iv) UID/Aadhar Card.
14. Company/Producer may, at its discretion contact the Registrant(s) and/or Contestant(s), if required, for any clarifications needed for the information provided in the registration.
15. The Company has the right at any time to require proof of identity and/or eligibility. Failure to provide such proof within a reasonable time could result in disqualification from the Program.
16. In case there is any mismatch of Contestant(s) details in any round of the Program, the Contestant(s) may be disqualified from further participation in the Program, if Contestant is unable to resolve discrepancies.
17. All personal details and information requested by and supplied to the Company by each Contestant must be truthful, accurate and in no way misleading. The Company reserves the right to disqualify any Contestant(s) from the Program or Audition in its sole discretion, should the Contestant(s) at any stage at any stage of the Auditions, supply untruthful, inaccurate or misleading personal details and/or information.
18. If at any time, including after disbursement of prize, any information submitted by the Contestant(s) is found to be incorrect, false, or otherwise misrepresented or misleading, the Contestant(s) shall be liable to refund all amounts received from the Company.
19. Company shall keep all the information collected from the Contestants confidential and shall share the same with the Producer for the purpose of inviting the Contestants, if selected. The Company shall ensure that the Contestants are contacted by the Producer or on behalf of the Producer only for the purpose of the present Program and all such information collected by the Company/Producer shall be destroyed if the Contestants are not selected. Company shall not share the information so collected with any party, save and except for the purpose of the present Program. The Contestants by providing the aforesaid sensitive personal information hereby agree that the company shall have the right to share the information so collected with such other third party and the Producer as required for the purpose of the Program and hereby agreed that they shall not file any claim against the Company for sharing for such personal information.
c. Speaking to the media and third persons
20. None of the Contestants shall, without the prior written approval of the Company, speak to the press or any other media or any third person, nor give any interviews or comments relating to the Auditions or any aspect of the Program or write blogs, post any messages in social networking or any site including but not limited to Facebook and Twitter. The Contestant(s) shall not disclose any information whatsoever relating to the Company/Producer to any other party. Violation of this clause shall immediately disqualify the Contestants prospects of further participation.
21. The Contestant(s) shall at all times keep confidential the selection process and all details regarding the Program including Audition which he/she might be informed of or which he/she might learn or come to know of as a Contestant(s) or as a short-listed potential candidate.
d. Telephony
22. In the event the Contestant(s) uses a phone or SIM card not registered in his name for registration, the Company will not be responsible to track the registered Contestant(s).
23. In case the Company is unable to reach the registered Contestant(s), the registration entry will be deemed as invalid.
24. In the event it is not possible to determine with certainty the person who registered from a particular telephone number/mobile number, that entry would be disqualified. Registrant(s) are requested to use phone numbers which are unique to them.
25. Company/Producer shall not be liable for any failure of SMS server or system, any call drops during participation or incomplete registrations submitted by Registrant(s).
26. Post submission of the entry via SMS, the Registrant(s) will not be permitted to modify / alter / change any details / answer submitted.
27. Only the Entries received during the Audition Period will be considered valid.
28. The Company shall endeavor to make all reasonably practicable arrangements to minimize telephone system difficulties and website downtime, ensure uptime of systems, back-up of data, telephone system capacity, and prevent other technical impediments, but cannot provide any guarantee in respect thereof as these are dependent on external utilities/ service providers.
29. Company and its sub-contractors are not responsible for delayed receipt or non-receipt or incomplete receipt or corrupt receipt of Registration entries.
30. The Company accepts no liability and shall not be responsible and/or liable in any manner whatsoever in case the Contestant(s) are unable to participate in the Program due to failure on the part of the telecom operator, facility provider, etc., or due to capacity constraints.
e. Auditions
31. The number of Auditionees and /or Participants to be selected shall be at the sole discretion of the Company / Producer.
32. The Company / Producer shall shortlist Participant(s) after the Auditions at all venues as required, out of which only a limited number of Participant(s) shall be selected for further selection processes in the Program. The Company can change the number/ratio of Participants selected at every level at its discretion with prior intimation.
33. If the fact of participation in the previous seasons of the Program or any previous programs based on the format “FASTEST FAMILY FIRST” across languages is found, the Participant will be disqualified at any stage even after he/she completes his/her participation in the competition and wins the prize money. In such case, the prize money won by the Participant will be forfeited.
34. Auditions will be subject to such timing stipulations and requirements as may be determined by the Company and the Company makes no representations, warranties nor provides any undertaking to any of the Contestant(s) that any or all the Contestants will be able to take part in Audition.
35. The Company shall not be liable nor responsible for any damages, losses, costs, expenses or otherwise suffered by any of the Contestant(s) in the event that the Company is not able to permit the Contestant(s) to take part in the Audition or Program in accordance with any of the foregoing provisions.
36. All cost incurred for participating in Auditions is to be solely borne by Auditionees.
37. If an Auditionee is unable to appear for the Audition at the stipulated venue and time, he/she shall be disqualified from further participation.
38. If an Auditionee is shortlisted at multiple audition locations (through same contact number or multiple contact numbers) then only one audition that he/she has attended, at the sole discretion of the Company / Producer, will be considered for evaluation.
39. Company shall not entertain any request by the Auditionees for change in the dates and venues of Audition.
40. The Audition process may take more than one day, and the Auditionee would be required to be present for the entire period of the Audition as informed by the Company/Representatives.
41. Notwithstanding any other provisions in these Rules and Regulations the Company may, at its sole and absolute discretion, cancel or reschedule the Auditions, or hold additional Auditions on such other dates and at such places as it may determine and the Contestant(s) shall adhere to and abide by any and all instructions, requirements and timing stipulations as determined by the Company and shall attend at any and all such additional Auditions.
42. For purposes of Auditions, the Auditionees can either come alone, or at best be accompanied by one other person, who cannot be a member of the media, but under no circumstance will any person other than Auditionee will be allowed to enter the venue. Cameras and photography by the Auditionee will not be permitted at the Audition or the Shoot venues.
43. The Contestant(s) understands that getting shortlisted in the Audition is only a preliminary step towards further participation in the Program and it shall be the absolute and sole discretion of the Company/Producer to allow participation based on creative requirements. It is clarified that the Company shall have the right to alter/change the Audition Centers at its sole discretion at any point of time without any prior intimation to the Contestants.
f. Short-listing
44. Apart from the Registrant(s), the Company may at its sole discretion provide a chance for entry to the Audition/ Program for unregistered individuals also, based on programming needs, should they arise, or in the event of participation selection process or system failure.
45. Company also has the right to conduct “celebrity special Episodes” or “seasonal special Episodes” where certain persons of prominence may be invited to participate in the Show without being required to go through the participation selection process.
46. Even after final selection for the Show, the Company/Producer shall have the right to replace any of the Participant(s) as per their discretion and creative requirement, for the betterment of the Program or Show.
47. The Company also reserves the right to increase or decrease the ratio of the Contestants in each Show i.e. increase or decrease the number of Contestant(s)who can participate in any levels of Program, without any prior intimation to the Contestant(s) and/or the public.
48. The Contestant(s) understand that their selection will be based on a randomizer and selection software.
49. The Company will not entertain and permit the Contestant(s) or any of their representatives to check / audit / challenge the logic of the randomizer or selection software.
50. The Company may in its sole discretion exclude a Contestant from participating in the Audition/ shoot of the Program which may include without limitation (i) circumstances which, in the Company’s view, renders the Contestant unfit to participate therein; (ii) inability to produce documentation specified by the Company proving the identity of the Contestant; (iii) any other reason that, at the discretion of Company, would adversely impact the Company, Channel or Program and (iv) if any information submitted by the Contestants at any level turns to be false and incorrect .
51. At no point of time will the Company/Producer be obliged to notify unsuccessful Contestants of its decision.
52. Whilst the Company shall make all reasonable endeavors to (i) enable Contestant(s) to proceed with the Show (ii) to contact all Contestant(s) at each relevant juncture of the Program, the Company can make no guarantee thereof and the Company shall in its sole discretion be entitled to proceed with the next entitled Contestant(s) under these Rules, in case it is unable to successfully contact and communicate with Contestant(s).
53. The Company will have no liability to a Contestant who is unable to attend or take part in the Program for whatever reason and the Company shall be entitled to disqualify the Contestant(s), replace any such Contestant(s) from the Program any time, at the discretion of the Company without any objection whatsoever.
54. The Company further reserves the right to replace at its discretion any Contestant(s) who for any reason fails or is disqualified from or unable to participate in the Program with another replacement Contestant(s), notwithstanding that such replacement Contestant(s) may have been previously eliminated from the Program and each Contestant shall agree to participate in the Program and/or Program as and when required by the Company to do so.
55. In the event that there is a tie between two (or more) Contestant(s), the Company shall be entitled to determine in its absolute discretion which Contestant(s) is eliminated and/or which Contestant(s) goes through to the next round (as appropriate) and for this purpose it shall be entitled to make such arrangements or request such further rounds from the Contestants as it in its absolute discretion based on any parameters as deemed necessary by the Company. No enquiries, appeals, verbal or written, shall be entertained in this regard.
56. All attempts will be made to protect registration data from loss and corruption, but in the event such data loss happens, and because of the intricate timelines of the Participant selection process, Company may have to continue with whatever data is available, or in any other manner as it may deem reasonable. The Company may in its sole discretion exclude a Contestant from participating in the Audition/Shoot of the Program which may include without limitation (i) circumstances which, in the Company's view, renders the Contestant unfit to participate therein; (ii) inability to produce documentation specified by the Company proving the identity of the Contestant; (iii) any other reason that, at the discretion of Company, would adversely impact the Company, Channel or Program.
g. Intellectual property rights and access to personal information
57. On request of the Company, the Contestant(s) shall also make arrangements for the Company to have access to his / her residence, workplace, favorite hangouts, pets, etc. and obtain necessary permissions from his / her parents, siblings, friends, colleagues to be photographed, interviewed and to record or click their photographs, videos etc.
58. As part of Contestants‟ contribution to the Program/Show, the Producer may request Contestant(s) to participate in any online/interactive activity relating to the Program/Show including without limitation recordings of webcasts, interviews and participation in so-called „chat-rooms‟. It is a further condition of entry and participation in the Program that Contestant(s) ensure and procure from any and all Contributors their agreement and execution of the release form as devised from time to time by the Company/Producer.
59. The Winner(s) of the Program agrees that he/she shall make himself/herself available from time to time and co-operate with the Company and participate in any activity and/or campaign (“Promotional Activity”) of any nature whatsoever without any money payable to the Winner(s). Further, the Winner(s)/Contestant(s) shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever if required by the Company. The Winner(s)/Contestant(s) agrees that the footage of any nature shall vest with the Company, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.
60. Participant (s) specifically agree, allows, grants and permits the Company or any party authorized by it to record (audio-video/audio or video), the participation process/performance at every level of the Audition, including the acts and performances at all Levels, any interaction of the Participant with the Company or fellow Participant or any representative of the Company, if any, of the Participant (s) rendered during the Auditions/Show or the Program or any related series of sound recordings and video recordings which have been shot during the Auditions/Show or the Program on film, tape or digital or other electronic media and includes recording of any personal questions or conversations relating to the personal lives of the Participant (“Footage”) and agree that the Footage may be used by the Company as it deems fit anywhere in the world at any time now or in the future, including but not limited for promotion of the Program. For the avoidance of doubt, all rights in the Footage vests exclusively with the Company worldwide in perpetuity and the Company is entitled to exploit the same in any manner it may deem fit.
61. In consideration of being afforded an opportunity to participate in the Program/Auditions, the Participants agree, represent and warrant that all Intellectual Property in and to the Materials shall remain the exclusive property of Company from the moment they arise, for the entire period of their subsistence, in every part of the world. To the extent, that the Intellectual Property or any rights, title and interest in the Materials, do not vest with Company, by operation of law, the Participant on an outright basis hereby irrevocably, exclusively, perpetually and for the entire world assigns and transfers all Intellectual Property vested in the Materials including rights in any Exploitation thereof to Company. To the extent that the assignment of rights, title and interest in the Intellectual Property in and to the Materials in relation to future medium or mode of exploitation of the Materials is not held valid by operation of law, notwithstanding the assignment of such rights in favor of Company, the Participant hereby grant an irrevocable, exclusive, sub-licensable, perpetual license to Company for such future medium or mode of exploitation of the Intellectual Property in and to the Materials as may be developed in the future, for the entire world. Notwithstanding the above, the Participant hereby agree that the Participant shall not assign or in any other manner transfer rights including the Intellectual Property in and to the Materials for such means and modes of exploitation of the Materials which are not mentioned herein and are not presently known or in commercial use and therefore by operation of law are not deemed to have been assigned to Company without offering for assignment such modes or means of exploitation of the rights including Intellectual Property in and to the Materials for the entire world and perpetuity to the Company (‘Offer’). The Participant agrees and acknowledges that any form of assignment or transfer of any rights, title and interest in any such future modes and mean of exploitation of the Intellectual property in and to the Materials to any third party in breach of the obligation herein, anywhere in the world shall be null and void. The Participant(s) waive off their “Moral Rights” with respect to the Materials/ participation in the Auditions/ Program. The Participant agree and acknowledge that the Channel /Company shall have the sole and exclusive right to edit, alter, modify and or use any Footage or Materials in any manner whatsoever it may deem fit and necessary at its sole discretion.
62. Any photographs, videos etc. submitted to the Company/Producers or recorded by the Producers during the Audition or registration procedure shall on submission / creation become the property of the Company and shall be available to the Company for exploitation throughout the world in perpetuity. The Contestant(s) shall ensure that the photos or videos submitted by them in any public domain, or their performances shall not be obscene, vulgar, defaming, denigrating women or children, hurting religious sentiments, depicting violence or shall not infringe the rights of a third person. In the event of any violation to the aforementioned, the Contestant(s) shall immediately be disqualified from taking part in the Auditions/ Program or any further rounds of participation and such Contestant(s) shall solely remain liable for any action (criminal/civil) arising therefrom.
63. Acceptance of these Rules and Regulations by the Participants / Contestants constitutes permission for the Company its affiliates and Producer to click photographs, record videos of the Contestant(s) and use the Contestant(s) name, photographs, likeness, voice and comments for advertising and promotional purposes in any media worldwide for purposes of advertising and trade without any additional compensation whatsoever.
h. Questions and answers
64. The Company or the Producers will not entertain any claims / questions / queries with respect to the authenticity or correctness of any questions and answers for the questions asked in any round of the Program.
65. The Company’s decision on the correctness or incorrectness of any answer is final and binding on all Contestants.
i. Expenses of participation & logistics
66. All cost including but not limited to travel and accommodation cost for attending the Auditions at the venues as informed by Company shall be borne solely by the selected Auditionees and the Company or its sub-contractors shall not be liable for the same.
67. The arrangements for travel and stay of the Participant(s) selected to attend the shoot will be made by the Producer.
68. The Company or any of the affiliates connected with the Program/Show shall not be liable for any cancellations and/or delays in the train/ flights/ cars arranged for the Contestant(s) due to any reason including but not limited to force majeure, logistical problems at the airports/ railway stations/ roads etc. and the Contestant(s) shall not have any claim against the Company and/or any of its affiliates connected with the Program and/or Producer for the same. The Company or any of the affiliates connected with the Program shall not be responsible for any such eventuality and the Contestant(s) undertakes not to claim any compensation from the Company/ Producer for the same.
j. Prize
69. The maximum prize which can be won in the Program is Rs.1,80,000/- (Rupees One Lakh Eighty Thousand only) or such amount as the Company deems fit.
70. It is not necessary that each Participant wins the maximum prize money. Each Participant shall be entitled to receive the prize money that he/ she is eligible to as per the format of the Program.
71. Any and all taxes and/or levies applicable on the prize money won by the Participant(s), under the laws of India shall be borne by the Participant(s) in relation to the prize. Payment of prize money to the Winner(s) shall be after deduction of all applicable taxes and levies and subject to providing the relevant documents as intimated by the Company and will be paid within the time stipulated by the Company. A duly attested copy of the PAN card is compulsory to claim the prize money by the Auditionee.
72. The Participant/s shall not be entitled to receive and /or claim the prize money irrespective of its value in the event that the Episode featuring him / her is not telecast or broadcast by the Company for any reason whatsoever.
k. Other terms
73. The procedures for registration and participation in the Program are subject to the Rules and Regulations stated herein. Non-conformance by any Contestant(s) to the rules of the Program will disqualify him/her from participation or winnings, immediately, as the case may be. The Company may refuse to pay winnings or reclaim all sums paid to Participant(s) in the event of his/her fraud, dishonesty or non-entitlement to participate in the Program under these Rules & Regulations.
74. In the event of any fault, misunderstanding or dispute concerning any part of the Program, and/ or the operation of the telephone system, Auditions, Call-backs, the selection of Contestant(s) at any stage, or the validity of any question or answer options, the decision of the Company shall be final and binding on all Contestant(s). The Company / Producer of the Program is empowered to take a decision on any case or instances not covered by the present Rules and Regulations.
75. The Company reserves the right to amend (add, delete or modify) the Rules & Regulations governing the Program and/or the Participant selection process prospectively or retrospectively, at its discretion and without prior notice, in order to improve the Program or remedy any issues that occur and any such additions, alterations or modifications to the rules and regulations may/shall be notified as separate amendments or addendums as may be decided by the Company at its sole discretion including for the next phases of the Program.
76. The Company has the right at any time to terminate the Program and /or levels or discard any levels without any prior intimation or notice to the public and also the Company is not obligated in any manner whatsoever to compensate any person or persons who have participated in the Program and/or accommodate any person or persons who have been selected for the Program.
77. Registration to the Program does not guarantee the selection of the Registrant(s) to proceed with the Program. Registration also does not entitle any Contestant(s) to a prize or award.
78. All registrations shall be subject to completion of the procedures by the Registrant(s) as per instructions received (i) through SMS, (ii) on the Channel; and (iii)as per the Rules& Regulations.
79. Taking part in the registration process, i.e level 1 shall be deemed to be acceptance by the Registrant(s) to receive promotional messages from the Company or any third party so authorized by the Company.
80. If the operation of the Program (including without limitation the operation of the related telephone systems, call center operations, and software systems); the recording; broadcast of any/all of the Show is prevented by an event of force majeure, the Company may cancel all or any part of the Program/Show, or take such other decision as it deems fit.
81. Notwithstanding a Contestant’s participation in the Program, there is no obligation on the part of the Company to broadcast any Show in which he/she has taken part, or any or all of his / her contribution as recorded by the Company.
82. The Company reserves the right to re-schedule the date(s) of registration, call-backs, Auditions, recording the Studio Part of the Program and broadcast, at its discretion.
83. In case the Winner(s) is found to be in violation of any and all rules/ process of the Program, the Company reserves the right to initiate legal proceedings against such person(s) including but not limited to requiring the concerned winner to refund the prize money won on the Show together with penalty interest as deemed fit by the Company.
84. If Contestant(s) are unclear as to the Rules &Regulations of participation he/she will have to send an email to fff@asianetworld.tv The Company shall make reasonable endeavors to respond thereto. The above shall not, however, be a ground for extension of time / deadlines as specified herein.
85. The Producer reserves the right to change the structure of the Program as it sees fit including without limitation by adding / reducing / altering Auditions/rounds to the Program.
86. It is a condition of entry and participation in the Program that Contestant(s) make themselves available to participate in the Program, agree and sign up the Contestant Release Form and any other documents as requested by the Company/Producer and abide by terms and conditions of such contestant release form and the Rules, Regulations as devised from time to time by the Company including but not by way of limitation these Rules & Regulations.
87. The Company’s decision (or, where appropriate, the decision of the Judges) is final and the Contestant(s) acknowledge that the interests of the Program/Show shall override those of any Contestant(s) and/ or Contributor.
88 It shall be the sole responsibility of the Participant(s) to familiarize themselves with the Rules and Regulations from time to time. Company reserves the right at its sole discretion to (i) cancel and/or postpone the Program without any prior intimation to the Participants (ii) make amendments to the existing Rules and Regulations or Period or Audition Period or withdraw, change, alter, amend the Rules and Regulations (iii) extend or curtail the Period or Audition Period or suspend or abandon the same at any time, and the Participant shall have no objection to the same whatsoever, nor shall the Participant make any claims /disputes in respect of the same. You further understand and acknowledge that you shall be solely responsible to visit the Website from time to time in order to be informed of any updates in the Rules and Regulations and abide by the same without any recourse to the Company for any reason whatsoever.
89. The Contestant(s) must at all times behave appropriately when taking part in the Program and observe these Rules & Regulations and any other Rules & Regulations in force at the Auditions and/or Studio. The Company reserves the right in its absolute discretion to remove from the Program, Audition, Studio any Contestant(s) who breaks such rules and/or fails to behave appropriately and to disqualify such Contestant(s).
90. These Rules &Regulations supersede any and all release forms signed by the Contestant(s) and in the event of any conflict between Contestant Release Form and these Rules & Regulations, these Rules & Regulations will prevail.
91. No weapons, alcohol or illicit substances will be permitted at any premises or during any part of the Program. Contestant(s) must be of good moral character and not be under the influence or habit of any medication, drugs or other psychotropic substance which may impair their ability to participate in the Program. Use of any prohibited substances could lead to disqualification.
92. If any provision of these Rules & Regulations is held by any court or other competent authority to be void or unenforceable in whole or part, the other provisions of these Rules & Regulations and the remainder of the affected provisions shall continue to be valid.
93. These Rules & Regulations and the Program shall be governed by and construed in accordance with the laws of India and the Contestant(s) submit irrevocably to the jurisdiction of the Courts in Cochin. Any disputes arising out of this Program shall be subject to the exclusive jurisdiction of Cochin city alone.
94. Use of mobile phones Laptops, Calculators or any other electronic gadgets will not be permitted during the shoot, and during the Auditions. It may lead to disqualification.
95. Registration does not guarantee the selection or participation of the Contestant(s) and such selection shall be as per the sole discretion of the Company or its affiliates.
96. The Company / Producer of the Program is empowered to take a decision on any issue related to the Audition levels and /or Program in case not covered by the present Rules and Regulations
l. Liability
97. The Company and/or the Channel is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any physical injury, death, mental trauma caused to any Contestant(s) and/or the Winner (s) in any manner whatsoever, in relation to the Program and/or prize.
98. The Company, Producers, Judges, the host, the advertising agencies, the sub-contractors used by Company for the Program, and any person or entity connected with the production (including the format owners and the broadcasters of the Program), administration or judging of the auditions, the Program or the Program (the “Relevant Parties”) shall be under no liability whatsoever to the Contestant(s) or the Contributors, in respect of any loss, damage suffered by the Contestant(s) or Contributors arising from or pursuant to the Program or for any and all loss, damage, cost, expense or injury to life or property sustained by the Contestant(s) or Contributors at any stage of the Program and during production thereof whether or not caused by (1) the administration (including scheduling) of the Program including any failure of transportation or inability for any reason to appear for the Audition/before the Judges; (2) the Contestant’s or any third party’s participation in the Audition, or being selected or disqualified; (3) as a result of the decisions of the Judges or Company; (4) as a result of any comment, remark, judgment, view, criticism, critique, opinion and/or observation made and/or passed by the Host and/or Company; and/or (5) any printing, typographical or technological errors in any materials associated with the Program. Notwithstanding the generality of the foregoing, the Relevant Parties expressly exclude liability for all direct, indirect and consequential loss or damage, including but not limited to loss or damage to property or for loss of profit, business, revenue, goodwill or anticipated savings pursuant to the Program. In no event will the measure of damages include, nor will the Relevant Parties be liable for, any amounts for indirect, incidental, consequential, or punitive damages of any party, including third parties; or for damages attributable to the Contestant(s); or circumstances beyond the Relevant Parties including the Producer’s reasonable control.
99. The Winner(s) and/or the Contestant(s) of the Program agrees that he/she shall hold harmless the Channel, Company, its employees, officers, sub-contractors or any other person in connection with the prize won by him/her and/or in relation to the Program including but not limited to the procedure in the Program and shall also not file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against sponsor and/or the Channel/Company/Producer to claim any damages or reliefs.
100. The Company / Producer will not be responsible for any loss / theft of belongings of the Contestant(s) on the sets of the Program/Studio, before/during/after the shoot of the Episodes/Show, or at the time of the Audition.
101. The Company / Producer or any of its affiliates will not be liable for any loss of earnings, employment or otherwise caused to the Contestant(s) and arising as a result of his/her participation in the Audition or the Show, if selected
102. Company / Producers and its sub-contractors cannot and shall not be held accountable/liable for any disruptions / stoppages / interruptions or cancellation of the Audition or Program on account of any factors beyond their control.
103. Company / Producer and its sub - contractors shall not be held responsible or accountable to any of the Contestant(s)/Contributor(s), for any loss, injury or any other liability which may arise, enroute while coming to the venue of Audition or while attending the Program / Shoot or while participating in the Program and for which the Contestant(s)/Contributor(s) will be required to sign an indemnity in favor of the Company. The Contestant(s)/Contributor(s) agree to release, discharge, and covenant, not to sue the Company or any of its associate agencies and each of their respective officers, directors, agents, representatives and employees, and/or any other agencies or individuals connected with the Program in any manner, from any and all claims, actions, damages, liabilities, losses, costs and expenses, in any way arising out of or resulting from the Contestant(s) involvement in the selection process.
104. The Contestants agree and undertake to keep the Company, Producer, the Channel ,its employees, officers or any other person indemnified from and against any third party claims or demands, cause of action, judgments, liabilities, losses, costs and expenses that may arise out of (i) any breach of the terms stated herein ,(ii)a result of any violation of any third party rights/material in with respect to the Exploitation of the Entry including the Video Auditions, by Company and /or any of its affiliate companies and/or channels, (ii) any actions or omissions by the Contestants while participating in the Audition / Program and (iv) anything related to their participation in the Audition in violation of the terms stated herein.
105. Apart from the entitlement to be part of the television, the Contestant or his / her legal heirs will have no other rights or claims against the Company or the Producers. For the sake of clarity, it is stated that the Contestant(s) of the Audition or the Program shall not be paid any consideration.
106. The only way to enter Program is through participation as described in Rules and Regulations. There is no other way of entering the contest. This entire process is transparent and monitored by an independent validator. Any person claiming that he/she can help get you win for a consideration is defrauding you. Please contact your local police and report this person immediately.
107. If the operation of the Show/ Auditions/ Program (including without limitation the operation of the telephone system); the recording; broadcast of any/all of the Shows is prevented by an war, industrial action, flood or any Act of God, or applicable law or any Act of God or the current Covid 19 Pandemic or any act beyond the reasonable control of the Company or any guidelines set up by the Central Govt. or Kerala State Government for shooting during the current Covid 19 Pandemic (“Force Majeure”) which continues for a period of fifteen (15) days, the Company may at its sole discretion cancel all or any part of the Show/ Programs/ Auditions and/or participation of a Participant(s)/Show Players forthwith and such decision shall be final and binding on the Participants and Parent on behalf of the Participant(s).
108. The Rules and Regulations have been originally written in English and translated in Malayalam. Any conflict in the interpretation of the clauses between the Malayalam and English versions, the interpretation as contained in the English version shall prevail.
109. The Company or the Producer shall be entitled to assign this document of Rules and Regulation and all other documents signed & submitted by the contestant(s) on account of this program, to any third party without any consent of the Contestant(s)
110. Auditionees shall not commit any act which is not permitted under any law in force including but not limited to applicable anti-corruption and anti-bribery laws.
